Provincial Offences Act

The interview conducted for the purpose of this project is sherrif Rob Ford, who has been appointed the new sheriff as recognition of his services for the city of Toronto. He is the law enforcer and my focus has been with regard to the implementation of the Liquor License Act. The objective is to address the issues elated to the historical development of the Act and the measures taken for its enforcement. The spending money allocated for the enforcement of the Act for the welfare of the citizens. How is he able to enforce his advice to the residents of Toronto? The specific study is done with regard to Liquor License Amendment Act(fruit Wine), 2009.The objective is to direct the interview to evaluate the Act clause by clause.

The personal interview of sheriff Rob Ford was done In March, 2011 with the objective of seeking direct response to some pertinent questions which may provide more indepth information with regard to Liquor License Amendment Act. The series of questions have been developed to conduct the interview and fulfill the requirements of the research.

1. Provide a historical description of the person being interviewed (Agency working for, years of employment, special duties, experience and investigations that they have worked on etc)

The police official being interviewed is sheriff Rob Ford, who has been in service for 20 years and has contributed to the law enforcement mechanism within the city limits with great success. His special duties entail enforcement of the Liquor License Amendment Act 2009. His experience is varied and practical in this field. The investigations reveal his controversial role as sheriff. He has been involved in the council for many years, has been sponsoring sports teams and has made enormous charitable donations.He is also very active in making sure that taxpayers get their due share of gains from the services of the community program.

2. What are the benefits of the Act (in question)?

The Liquor License Amendment Act ( fruit Wine), 2009 which has been been an issue of discussion with the community members. It provides producers of fruit wines an extensive ability for expansion in marketing their produce. It generates ample opportunities for developing marketing, rural economic development as well as tourism development.

3. What are the problems with the Act (as legislated)experienced by the professional

The issues related with Act are directly connected with underage drinking in social scenario. Hence proceedings need to be strictly implemented in practical ways.

4. What (if any) legislative changes would assist the professional in the use of the Act

The legislative changes empower the rural farmers with more opportunities for sale of their produce. The objective is to protect the wineries and give boost to farming. The legislation restricts the implementation of the fruit wine production and marketing within the limits of Ontario.

5. What other agencies does this person work with?

He represents on various councils and is very active in the community affairs where specific implementation of liquor Act is concerned. He has always been involved with the police department in various positions for the last twenty years.

6. How often does the person use search powers under the Act?

He reported that it has not been too often that he would have to use search powers. The community is soundly law abiding. He has encountered five scenarios under which he had to use search powers for rightful implementation of the law.

7. How often does the person use powers of arrest under the Act?

In the span of twenty years of service to police department, he had to arrest under the specific implementation of the Liquor Act, 2009 six times.

8. What is the most common release document employed by the person?

The most common release document is their identity proof or the driver's license which has been verified and presented as the release document.

9. What is the average length of time from the time of laying a charge and the resulting plea/trial?

The trial time based on the age of the defaulter can vary in length. If it is the case of underage person, it takes long reformative proceedings. If it an adult of responsible age it may take weeks or months to wrap up the entire process.

10.  What are some of the sentences being imposed on the offenders?

The offenders have to pay the penalty and commit to community service. In case of underage person imposed with sentence the period of reformative program is longer so that reformative changes can be monitored and implemented.

11.  Explain the relevant procedures in the Provincial Offences Act selected.

The relevant procedure entails requests from farmers market, social responsibility in terms of the conditions of the sale. There is restricted sampling and limit to the jurisdiction.

12.  Identify which non-police agencies are involved with each statute.

The statue involves the participations of the farmers council which would regulate sampling and hold accountable within the limit zone.

13. Explain the role of these agencies in resolving problems.

The agencies primarily focus on nurturance of social responsibility in the wake of dramatic rise in scope for marketing the product under the Act. "Fruit winery owners are professionals, as farmers are professionals, with farmers contributing more to the planet and society, I would argue, than any other group of professionals. Ostensibly, Bill 132 is designed to improve retail access for Ontario fruit wines by authorizing their sale at Ontario farmers' markets"(Committee Transcripts, 2010).

The research paper is aimed to provide facts from a real interview of the sheriff, Rob Ford who has been instrumental in providing first hand facts and figures in relation to the Bill 132 under Liquor License Amendment Act which has been a compelling force for the farmers to expand in sale and distribution of their product within the jurisdiction of Ontario.

This Act has affected fruit wine s one of the highest taxed consumer product which has been a boost to spirit suppliers and acknowledgement for the suppliers. The social responsibility factor is significant in terms of defining the Act for implementation purposes. The Act gives "producer and give them some kind of special treatment. Instead, as we do with virtually every other product, legislators should decide on the overall amount of revenue the Ontario treasury needs to derive from the sale and distribution of alcohol, and then allocate that fiscal burden fairly and evenly across all parties."

The Act has been instrumental in supporting the farming community and actively aims to generate good pricing, lowers taxation and expanded marketing opportunity for the farmers market.
