Civil rights hare the rights bestowed unto individuals guarantying them equal treatment, and fair from any forms of discrimination. The said rights are enforceable and where violated, either through interference and or denied one can claim damages. Various jurisdictions have protected different civil rights amongst them being that against physical limitations (Reed, 1998).
Civil rights find there origin in the fight of the minorities trying to have a voice of their will. It has even been linked largely to the struggle of African Americans in the 1950s and 1960s for equality with their fellow white citizens.
Having in mind what entail civil rights, one must appreciate that children with disabilities are a minority and as such subject to protection under the said rights. Further in reference to the Thirteenth and Fourteenth amendments of the American Constitution, disabled people are amongst the people the amendments expressly sought to protect.
The ADA or Americans with Disability Act and in particular Section 504 of the Rehabilitation Act of 1973 are to the extent of ensuring that children with disability are afforded the same respect, rights and even protection as their counterparts who are without disability. Further, families are to be involved with the education of their disabled children as they are the ore caregivers of such children. As such they have their trust and are likely to be alerted if their rights are violated. Bearing this in mind, the family of children with disability is thus a subject of civil rights by right.
It's thus apparent that schools should, to a large extent follow the provisions of ADA, and or IDEA (Individuals with Disabilities Education Act). This is because the guidelines give an overview which if applied, would ensure uniformity in the treatment of disabled children and at the same time ensure that their rights are protected without violating the rights of others.
